What are cookies?

Cookies are data created by a server and stored as text files on your device’s hard drive. Types of cookies

Italian law (Article 122 of Legislative Decree 196/03, the “Privacy Code”) implemented EU Directive 2009/136/EC, requiring website operators that use cookies or other tracking technologies to inform users about the types of cookies used. Decision No. 229 of 8 May 2014 by the Italian Data Protection Authority (published in Official Gazette No. 126 of 3 June 2014) classified cookies into two main categories: “technical” cookies and “profiling” cookies.

1. Technical cookies. Technical cookies, usually installed by the website owner or operator, are intended to “carry out the transmission of a communication over an electronic communications network, or as strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service” (see Article 122(1) of the Privacy Code). Technical cookies are further divided into:

  • Browsing or session cookies, which ensure normal browsing and use of the website, allowing, for example, purchases to be completed or authentication to access restricted areas. These cookies are not stored persistently on the user’s device and are automatically disabled when the browser is closed. Their use is linked to the transmission of identifying data necessary to ensure secure and efficient browsing. Session cookies do not allow in any way the acquisition of personally identifying data about the user.

  • Analytics cookies, used to collect information about website use in an anonymous form and to obtain statistical analyses of viewed pages and user behaviour. Article 122 of the Privacy Code states that “the storage of information in the terminal equipment of a contractor or user, or access to information already stored, is permitted only on condition that the contractor or user has given consent after being informed using the simplified procedures referred to in Article 13(3)” (Article 122(1) of the Privacy Code).

The same Decision also classifies cookies based on the entity acting as the controller of the personal data collected by the cookie, distinguishing between “first-party” and “third-party” cookies.

First-party cookies These are cookies managed by the website owner. For these cookies, the obligation to provide information lies with the website owner, who must also indicate how to block the cookie, if applicable.

Third-party cookies These are cookies managed by a third party other than the website owner. For these cookies, the obligation to provide information and indicate how to block the cookie lies with the third party; the website owner must include a link to the third party’s website where such information is available. For both first-party and third-party cookies, where consent is required (profiling cookies), consent is obtained via a dedicated banner on the website’s home page.

  4. DISCLOSURE OF DATA Without prejudice to disclosures required by law, data may be communicated to the Controller in order to carry out the functions necessary for the correct performance of the intended activities.
